“Dr.” O’Neill was hired by AllState to be an INDEPENDENT Medical Examiner and testify against my wife in a jury trial to refute the two doctors who are treating my wife for her permanent injury and both report separately that her injury was caused by being rear-ended at high speed by an uninsured driver.

O’Neill’s only examination was rushed (30 minutes to get an full medical history and perform an exam of her actual back injury (which he spent <5 mins on)) and he tried to railroad my wife into agreeing to things that weren’t in her history by racing through notes and then asking her “correct?” And giving her no chance to actually process or respond. Then, when she did hear something incorrect and tried to correct him, he wouldn’t listen and just moved on. My wife had to file a “corrections” document with her lawyer after the report came out since it was so full of errors and mis-quotes of my wife. She even brought a nurse witness with her to be a third set of eyes and ears and give her own report after the fact. O’Neill refused to share his measurements and notes with the nurse by saying “I don’t have time for that. It will be in my report.”

Afterwards, AllState’s lawyer objected in court to letting that nurse testify or even be allowed to tell the jury she attended the visit because they knew she would torpedo O’Neill’s creditability as being independent.

On the stand in trial, O’Neill wasted a lot of time telling stories about himself that had nothing to do with the case but made him seem more important than he is, and he promoted his new book. His testimony for AllState was that there was “no chance based on the evidence he reviewed and summarized in his report” that the injury could have been caused by the accident. This opinion goes against both treating doctors’ opinions (and common sense), but is EXACTLY what AllState wanted to hear, which is highly coincidental for a supposedly “independent” party.

When my wife’s lawyer was able to cross-examine him, his entire story fell apart and it was clear he was ignoring all of the evidence that helped my wife’s case in his summary and opinion. I was hoping he would be charged with perjury for the number of times he had to retract what he said during his testimony for AllState’s lawyer and I will be speaking with our lawyer and the American Medical Association to find out if he can be punished for his blatant selling out to AllState and perjury on the witness stand when he is supposedly “credentialed” as an Independent Medical Examiner.

I give him 1-star for his medical and ethical capabilities; but for being a witness hired to go against my wife, he might have actually helped her case more than hurt it with how poorly he testified and got caught telling lies (or "mis-truths") on the stand.
